PRIVACY POLICY
for applicants
We are pleased that you are interested in Müller Partner Rechtsanwälte GmbH, Rockhgasse 6, 1010 Vienna, start@mplaw.at, ("MPLAW") and are applying for a position in our law office.MPLaw gives highest priority to the protection of your personal data. We therefore process your personal data only if there is a legal basis and in compliance with data protection regulations. In this data privacy policy we inform you which data we collect and for what purposes we process them when you apply to us.
1. WHAT ARE PERSONAL DATA?
Personal data are all information relating to persons whose identity is determined or identifiable (e.g. name, contact details, date of birth).
2. FOR WHAT PURPOSES AND ON WHAT LEGAL BASIS DO WE PROCESS THE DATA OF OUR APPLICANTS?
We either process your personal data that you send us in connection with your application or that arise during your job interview
- to carry out pre-contractual measures or to fulfil our contractual obligations (Art. 6 para. 1 lit b DSGVO) in the context of the application process or in preparation for a later employment relationship;
- to fulfil our legal obligations (Art. 6 para. 1 lit c DSGVO) e.g. registration as employee with social security; and
- within the scope of your consent (Art 6 para. 1 lit a DSGVO): If you have given us such consent (e.g. to be able to keep your application in evidence), processing will only take place in accordance with the purposes stated in the declaration of consent and to the extent agreed therein. A given consent can be revoked at any time (see point 7. below).
3. AM I OBLIGED TO PROVIDE DATA?
As part of the application process, you have to provide us with the personal information necessary to verify your suitability for the job position and, if applicable, for social security registration. If you do not wish to provide us your data, we will not be able to process your application. However, you are not obliged to give additional consent.
4. WITH WHOM DO WE SHARE YOUR DATA?
Within our company, those departments or employees will receive your data who need them to fulfil their contractual and legal obligations. We will not share your personal data with third parties unless it is necessary to achieve the intended purpose. In individual cases the following recipients are considered:
- External payroll (if necessary in the application process and for social security registration),
- Vienna Bar Association (to register as an associate (lawyer in training)).
5. HOW LONG DO WE STORE YOUR DATA?
We only store your personal data for as long as we need it to fulfil the purposes described above. If you, as an applicant, do not consent to keep your application in evidence, your personal data will be deleted seven months after the application process has ended.
6. HOW DO WE PROTECT YOUR DATA?
We use technical and organizational security measures to protect your data against unauthorized, illegal or accidental access, processing, use, manipulation, loss or destruction. Our security measures are continuously improved in line with technical progress.
7. WHICH RIGHTS DO YOU HAVE?
You have the right to obtain information about your personal data at any time. Furthermore, you have a right to rectification and deletion, data portability and restriction of processing.
You have the right to revoke your consent to the processing of your personal data at any time. As a result, we are no longer allowed to continue data processing based on this content in the future.
IF YOUR PERSONAL DATA IS PROCESSED ON THE BASIS OF LEGITIMATE INTERESTS, YOU HAVE THE RIGHT TO OBJECT TO DATA PROCESSING AT ANY TIME IF YOUR PARTICULAR SITUATION CAUSES SUCH REQUEST.
You are welcome to contact us if you believe that we violate the data protection regulations when processing your data. You can also complain to a data protection authority. In Austria, the Österreichische Datenschutzbehörde (Austrian Data Protection Authority) is responsible for such purposes.
